Terms of Service

By using SpendSmart AI ("the app"), you agree to these terms. Please read them carefully.

1. The service

SpendSmart AI is operated by KCH Labs, a sole proprietorship of Heston Baptist Dsouza, based in Mumbai, India ("we", "us"). It's a personal expense-tracking tool, provided for your own money management and convenience. It is not financial, accounting, investment, or tax advice. Decisions you make based on the app are your own responsibility.

2. Your account

You create an account with an email address and password, or a supported sign-in provider (Google, Apple). You must be at least 18 years old to create an account or use SpendSmart AI. You're responsible for activity on your account and for keeping your sign-in credentials secure. We are not liable for loss caused by unauthorized access resulting from your credentials being shared or compromised.

2a. Shared groups and split bills

A group is a shared record, not your private one. Everything inside it is visible to every member of that group, and any member can add, edit or delete any expense in it, including entries you created. That is deliberate, because a bill belongs to the people on it rather than to whoever typed it in first. If you are not comfortable with that, do not put it in a group.

You may add a person to a group by name alone, before they have an account. If you do, you are responsible for what you enter about them. Invite links stop working on a date the host sets when creating them, no more than 90 days out. Groups require a connection: you can read a group offline, but adding, changing or settling anything needs you to be online.

A group record is shared, so it does not leave when you do. If you leave a group or delete your account, the entries you were part of remain and the name you used stays on them, so that the other members' balances remain correct. Your account is detached from them. Section 7 of the Privacy Policy sets out what deletion does and does not remove.

The balances SpendSmart AI shows are arithmetic on what members have entered. They are not a statement of any legal debt, and we do not arbitrate. A disagreement about who owes what is between the members of that group.

2b. Payment handles

You may optionally save a payment handle, such as a UPI ID or a PayPal address, so that the people in your groups who owe you money know where to send it. This is off until you add one, and you can clear it at any time.

SpendSmart AI does not move money. We do not process, route, hold or refund any payment, we do not verify that a handle is correct or that it belongs to the person it is shown against, and we are not a party to a transfer you make. A payment you send using a handle shown in the app is a transaction between you and that person, made in your own banking or payment application, and it is subject to that provider's terms.

Check the recipient before you send anything. If you publish a handle, you are responsible for its accuracy. We never ask for a card number for this purpose, and card payment methods are excluded from the feature.

2c. View links

A group can be opened to people outside it with a view link. This is off unless a member turns it on. While it is on, anyone holding the link can see every member's name and what each of them owes or is owed, with no account and no app, so the link itself is the key.

The member who turns sharing on, and anyone who forwards the link, is responsible for who receives it. Any member of the group may stop the sharing at any time, and it stops working immediately for everyone. A view link does not expire on its own.

2d. Picking your own items from an invite link

Where a group expense was split line by line from a receipt, the invite link sent to a person shows them the lines of that receipt and lets them tick the ones that were theirs. They do this on a web page, with no account and without installing anything, and these terms apply to that use of SpendSmart AI in the same way they apply to use of the app.

Ticking a line is an entry in a shared record. It changes what that person's share of the expense comes to, and therefore what the other members of the group are shown as owing or being owed. A line can be taken by one person only, and the page says how many lines have already been taken, never by whom. The person picking is responsible for picking honestly, the same as any member entering an expense.

The member who sends the link chooses who receives it. The link is addressed to one person, it expires, and any member of the group may withdraw it at any time. As with section 2a, the resulting balances are arithmetic on what people have entered: they are not a statement of any legal debt, and a disagreement about who had what is between the members of that group.

3. Subscriptions

SpendSmart AI offers a free tier and a paid Pro subscription. Prices vary by region; see the current monthly and yearly rates at spendsmartai.online or in the app.

Because these providers act as the merchant of record, the payment contract, tax treatment, and invoice for your purchase are handled by them rather than by SpendSmart AI. For a refund, contact the platform you purchased from (the Dodo Payments customer portal for web, or Apple/Google for mobile).

Subscriptions renew automatically until cancelled. You can cancel at any time through the platform you purchased from.

Prices are displayed in your local currency, and subscription amounts may vary by region.

4. Acceptable use

You agree not to misuse the app, including attempting to disrupt the service, reverse-engineer it, access other users' data, or use it for any unlawful purpose.

4a. Suspension and termination

You may stop using SpendSmart AI at any time, and you can delete your data or your whole account from inside the app.

We may suspend or close an account that breaches these terms, is used unlawfully, is used to abuse a shared feature or one of our public forms, or is used to attack or disrupt the service. Where it is practical and lawful to do so, we will tell you first and give you a reasonable opportunity to put it right. We may act without prior notice where waiting would risk harm to another person, to the service, or to us, or where the law requires it.

If we close your account you keep your right to export your data, and section 2a continues to govern any group records you were part of. We may also withdraw the service itself, in which case we will give reasonable notice so that you can export a copy first.

4b. Content you provide

What you enter remains yours. You grant us only the limited permission needed to run the service for you: to store it, sync it between your own devices, show it back to you, share it with the members of a group where you have chosen to put it, and send it for processing to the providers listed in the Privacy Policy, including the AI provider that reads your text, receipts and statements.

When you import a file, such as a bank statement or an export from another application, you confirm that you are entitled to upload it, including where it contains details about other people. You must not upload content that is unlawful, or personal data about somebody else that you have no right to provide.

If you send us feedback and tick the box giving permission, you allow us to publish your rating, your display name and your country as a testimonial on our website. We never publish your email address, and you can ask us to remove a published testimonial at any time by emailing us.

5. Availability & limitation of liability

The app is provided "as is" and "as available". While we work to keep it reliable and accurate, we do not guarantee that it will be uninterrupted or error-free. The AI features can be wrong. Categorization, the amounts, dates and merchants read from a receipt or a statement, and the monthly insight summaries are all produced automatically, and you should check anything you intend to rely on. SpendSmart AI is a record of what you tell it, not a source of truth about your money. To the maximum extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the app. Your data remains exportable so you always retain a copy.

6. Changes

We may update these terms as the app evolves. Material changes will be reflected here with a new "last updated" date.

7. Governing law

These terms are governed by the laws of India, and any disputes are subject to the jurisdiction of the courts of India.

7a. General

Your consumer rights are unaffected. Nothing in these terms limits any right you have under consumer protection law that cannot be limited by agreement.

These terms, together with the Privacy Policy, are the whole agreement between us about SpendSmart AI. If any part of them is found to be unenforceable, the rest continues to apply. If we do not enforce a term straight away, we do not give up the right to enforce it later. You may not transfer your rights under these terms to somebody else; we may transfer ours if the business is sold or reorganised, and your rights under these terms will not be reduced by that.

The apps update themselves, including over the air, so that fixes and changes reach you without a manual step. Using SpendSmart AI means accepting those updates.
